초록

The types of terrorism damage specified in the Act on Prevention of Terrorism for the Protection of the People and Public Safety and its Enforcement Decree and the types of disaster damage specified in the 「Disaster and Safety Management Basic Law」 and its Enforcement Decree are completely different from the legislative purpose and legal nature. However, there is some overlap between the type of “terrorism” specified in the Counter-Terrorism Law and the type of “social disaster” specified in the Disaster and Safety Management Basic Law. Accordingly, this article needs to examine whether the terrorism response system under the Counter-Terrorism Law is lacking or what needs to be supplemented compared to the disaster preparedness and response system specified in the Disaster Safety Management Basic Law. Therefore, if it is possible to thoroughly prepare in advance through the regularization of preparedness plans in preparation for terrorism occurrences and clarify the response activity standards in case of terrorism occurrences and apply them appropriately to the situation through comparison of the response regulations in the Disaster and Safety Management Basic Law, It will be possible to pursue the purpose of the Counter-Terrorism Law, which is to calm confusion, minimize damage to people’s lives and property, and secure national and public safety.
