본 연구는 한국에서 입법 후 평가(Post-Legislative Scrutiny, PLS) 제도의 효과적인 도입과 정착을 위한 현실적 방안으로 일몰 규제 심사 절차와의 연계 모델을 제시하였다. 입법 과정의 완결성 을 높이는 PLS 제도는 그 필요성에도 불구하고 정치적 민감성과 행정적 부담으로 인해 국내 정착에 어려움을 겪어왔다. 본 연구는 이미 법제화되어 운영 중인 일몰 규제 심사 절차를 활용함으로써 제도 도입의 정치적･행정적 비용을 최소화하는 접근법을 채택하였다. 연구 결과, 정부의 일몰 연장 요청 단 계부터 국회 상임위원회 심의 단계까지 PLS 결과를 체계적으로 반영하는 환류 모델을 설계하였으며, PLS 수행 주체와 방법론 표준화, 국회 입법지원조직의 역할 강화 방안을 제시하였다. 또한 모델의 현 실적 작동을 위한 정치적 수용성 확보 전략과 행정적 실행력 제고 방안을 논의하였다. 본 연구의 제안 은 법률의 질적 개선과 규제 합리화를 통한 국가 경쟁력 강화에 기여할 것으로 기대된다.

This study proposes a practical model for effectively implementing Post- Legislative Scrutiny (PLS) in South Korea by linking it with existing sunset regulation review procedures. Despite its necessity for enhancing legislative completeness, PLS has faced implementation challenges due to political sensitivities and administrative burdens. This research adopts an approach that minimizes political and administrative costs by utilizing already-established sunset regulation review procedures. The study designs a comprehensive feedback model that systematically incorporates PLS results from the government’s sunset extension request stage through to National Assembly committee deliberations. It presents standardized methodologies for conducting PLS, clarifies responsible entities, and enhances the role of legislative support organizations. Additionally, the research discusses strategies to secure political acceptability and improve administrative effectiveness for practical implementation. The proposed model is expected to contribute to national competitiveness by improving legislative quality and rationalizing regulations through evidence-based policy-making processes.
