본 연구는 한국 산업현장에서 증가하고 있는 외국인 근로자의 지게차 무면허 운전 실태를 분석 하고, 이들이 정당하게 교육을 받고 자격을 취득할 수 있도록 하는 제도적 개선방안을 제시하는 것을 목적으로 한다. 현행 법령상 내국인과 외국인 모두 1종 보통 운전면허 취득 후 지게차 안전교육을 이 수하고 면허를 발급받아야 현장에서 작업할 수 있다. 그러나 실상은 언어장벽과 교육접근성 부족으로 인해 다수의 외국인 근로자가 무면허 상태로 지게차를 운전하고 있으며, 이는 산업재해 발생 시 산재 보상 배제 및 법적 불이익으로 이어지고 있다. 본 연구는 선행연구 검토와 법령 분석을 통해 외국인 근 로자의 지게차 운전 자격 취득 제도의 문제점을 규명하고, 다국어 교육 프로그램 의무화, 교육기관 확 대, 자격인정 절차 간소화 등의 구체적 개선방안을 제안한다. 본 연구는 외국인 근로자의 산업안전보 건 권리를 보장하고 산업현장의 안전성을 제고하는 데 기여할 것으로 기대된다.

This study aims to analyze the current state of unlicensed forklift operation among foreign workers in Korean industrial sites and to propose institutional reform measures that enable them to receive proper education and obtain qualifications legitimately. Under current regulations, both domestic and foreign workers must obtain a Class 1 ordinary driver's license, complete forklift safety training, and receive a license before operating forklifts at work sites. However, in reality, many foreign workers operate forklifts without proper licenses due to language barriers and lack of access to education, which leads to exclusion from industrial accident compensation and legal disadvantages when accidents occur. This study identifies problems in the current forklift driver qualification system for foreign workers through literature review and legal analysis, and proposes specific reform measures including mandatory multilingual education programs, expansion of educational institutions, and simplification of qualification recognition procedures. This research is expected to contribute to ensuring the occupational safety and health rights of foreign workers and enhancing safety in industrial workplaces.
