초록

대한민국은 분단국가이며 휴전국가이기도 하다. 이러한 이유로 우리 헌법 제39조에는 모든 국
민은 법률이 정하는 바에 의하여 국방의 의무를 지며 누구든지 병역의무의 이행으로 인하여 불이익한
처우를 받지 않는다고 명시하고 있다. 하지만 이러한 군 인권에 대한 교육이 현실적으로 잘 이루어지
고 있는지에 대한 부분과 군 인권교육 교재 및 강의자료 등의 적절성 또한 논란의 대상이 되고 있다.
인권교육의 경우 병사의 24.7%가 최근 1년 이내 인권교육을 이수한 경험이 없다고 응답하였으며, 여
군의 경우는 17.2%, 간부(남군)의 경우에는 7.8%가 이수경험이 없다고 응답하였다. 또한 국군 인권
교육 교재에 담긴 표현이나 내용에 왜곡된 인권 의식이 있어 이를 바로잡아야 한다는 내용이 언론에
보도된 적이 있으며 인권교육에 대한 효과 또한 많지 않다는 것을 확인할 수 있었다. 이에 따라 본 연
구에서는 군 인권교육에 대한 전반적인 내용을 살펴본 후 이에 대한 문제점 및 개선방안을 제시하였
다. 우선 군 인권교육의 근거가 되고 있는 법령들을 살펴본 후 개선되어야 할 사항을 도출하고 어떻게
개선되어야 할지에 대해 논하였다.

The Republic of Korea is a divided country and a ceasefire country. For this
reason, Article 39 of our Constitution states that all citizens have the duty of national
defense as prescribed by law and that no one shall be subjected to disadvantageous
treatment due to the performance of military service obligations. However, whether
education on military human rights is being carried out realistically and the
appropriateness of military human rights education textbooks and lecture materials are
also subject to controversy. In the case of human rights education, 24.7% of soldiers
responded that they had no experience completing human rights education within the
past year, while 17.2% of female soldiers and 7.8% of executives (male soldiers)
responded that they had no experience of completing human rights education. In
addition, it has been reported in the media that there is a distorted awareness of human
rights in the expressions and content contained in the Armed Forces human rights
education textbook and that this must be corrected, and it has been confirmed that the
effect on human rights education is not much. Accordingly, this study examined the
overall content of military human rights education and presented problems and
improvement measures.
