초록

군내에서는 많은 훈련과 작업 등 각종 업무를 실시하고 있다. 이를 보통 군에서는 복무상 ‘책무’
라고 한다. 특히 장교 및 부사관과 달리 병의 경우 직무를 수행함에 있어서 어떠한 위험이나 어려움에
부딪히더라도 맡은 바 임무를 완수하여야 한다는 규정 하에 각종 작업 등이 많이 이루어지고 있다는
것이 우리 군의 현실이다. 군 업무 특성 상 기밀성 및 폐쇄성으로 인해 군 내에서 발생되는 각종 사건들은 대
부분 언론 등에서 확인되고 있다. 언론에 나오는 군 관련 사건들 이외에 공개되지 않은 사건들은 과연 얼마나
많겠는가. 물론 군 업무 특성 자체를 무시할 수 없다. 다만 지금까지 공개된 국방 관련 법령 및 규칙들에 대해
관심을 가지고 평시 전투력 보전 및 군 업무의 효율성을 위해 제도개선을 논하는 것은 매우 중요하다. 그런 의
미에서 국방 안전사고 조사절차 개선방안을 논하는 이유도 이러한 노력의 일환 중 하나이다. 국방 안전사고 조
사절차를 강조하는 이유는 사고원인을 규명하여 향후 안전사고예방을 위한 선 순환적 과정을 보다 원활하도록
만들기 위해 사고조사절차에 대한 논란의 여지를 줄이기 위함이다. 그러므로 국방안전훈령상 명시되어 있는
안전사고 조사에 관한 규정은 개선되어야 하며 개선되어야 할 방안은 행정조사기본법상에 명시되어 있는 각종
조사 절차 및 방법에 관한 규정을 적용할 수 있도록 해야 할 것이다.

The In the military, various tasks such as training and work are conducted. In
the military, this is commonly referred to as a ‘duty’ in terms of service. In particular,
unlike officers and noncommissioned officers, it is a reality in our military that many types
of work are being carried out under the stipulation that soldiers must complete their
duties no matter what dangers or difficulties they face in performing their duties. Due to
the confidentiality and closed nature of military work, various incidents that occur within
the military are mostly confirmed in the media. How many undisclosed cases are there
besides military-related cases that appear in the media? Of course, the nature of military
work itself cannot be ignored. However, it is very important to pay attention to the
national defense-related laws and regulations that have been disclosed so far, and to
discuss institutional improvement for the preservation of combat power during peacetime
and the efficiency of military affairs. In that sense, the reason why we are discussing
ways to improve the defense safety accident investigation process is one of these efforts.
The reason why the defense safety accident investigation procedure is emphasized is to
reduce the scope for controversy over the accident investigation procedure in order to
make the virtuous cycle process for future safety accident prevention more smooth by
identifying the cause of the accident. Therefore, the regulations on safety accident
investigations specified in the Defense Safety Order must be improved, and the method
to be improved is to apply the regulations on various investigation procedures and
methods specified in the Framework Act on Administrative Investigation.
