현대 안보환경의 복합화와 병역자원의 급격한 감소로 인해 민간 전문가의 국방 분야 활용이 핵 심 과제로 부상하고 있다. 본 연구는 국방민간전문가풀(DCTP) 제도 도입을 위한 법적 기반 마련을 목 적으로 싱가포르와 독일의 민-군 통합 인력운용 법제를 비교분석하였다. 분석 결과, 싱가포르는 통합 적 단일법 체계를 통해 효율성을 확보하고 있으며, 독일은 헌법-기본법 연계를 통해 민주적 통제와 전 문성을 강조하고 있다. 반면 한국은 분산적 다원 체계로 인한 법령 간 공백과 중복이 존재한다. 이에 따라 단계적 법제 개정 전략을 제시하였으며, 즉시 추진사항으로 국방인력개발법과 근로기준법 개정, 중기적으로 특별법 제정, 장기적으로 법체계 통합을 제안하였다.

The increasing complexity of modern security environments and rapid decline in military-age population have made the utilization of civilian experts in defense sectors a critical challenge. This study aims to establish a legal foundation for implementing the Defense Civilian Talent Pool (DCTP) system through comparative analysis of civil-military integrated workforce management laws in Singapore and Germany. The analysis reveals that Singapore ensures efficiency through an integrated single-law system, while Germany emphasizes democratic control and expertise through constitutional-basic law linkage. In contrast, Korea faces legal gaps and overlaps due to its dispersed multi-law system. Accordingly, this study proposes a phased legal reform strategy: immediate amendments to the Defense Human Resource Development Act and Labor Standards Act, medium-term enactment of special legislation, and long-term legal system integration.
